Who will be the custodian of the child after a divorce? Father or Mother ?
Under the law in Bangladesh, a father is the natural ‘guardian’ of his child while a mother the ‘custodian’ until a certain age. Mother is entitled to minor’s custody even if she had to leave the home of her husband under unavoidable circumstances. This means that the guardian/father will have to perform the duties, including the duty to provide for maintenance of the child though the mother will be able to retain the custody of the child.
A mother is entitled to custody of her son until the age of 7 years old, and her daughter until she has obtained puberty. A divorce does not end these rights, unless she marries a second husband in which case the custody belongs to the father.
The legal control of the children vests in the father even on divorce This means that he will have a duty to provide child support even if the child is living with the other parent.
